A Federal District Court has ruled that part of New York's draconian advertising rules are unconstitutional. Unfortunately the ruling relates to the use of pop-ads on the Internet, so it is of little relief to most law firms. On the other hand, this is a step in the right direction, and hopefully another court will strike down some of the other rules such as the requirement to put the words "attorney advertising" on the bottom of a firm's website. All industries, including professional services, are making sensible use of the Web to display their credentials and other information through commentary, images, video and other media. The more that lawyers are permitted to do so, the more potential clients will be able to evaluate them.
